Epitaph artist Death By Stereo is among those named in four multimilion dollar lawsuits by the family of Daniel Martin as well as other individuals hurt in a 2003 show which took place at the Solar Haus. According to the story, the lawsuits rest on the argument that "Solar Haus owners and former residents did not have legal permission to hold a concert at the venue, which they claim was unsafe.." Daniel Martin's family also claims that "moshing" and other violent behaviour exhibited by Death by Stereo contributed to their son's death.

The band, who performed benefit shows to aid with medical bills, has yet to issue a statement. One student who was present at the show in question had this to say:

[…] those in attendance willingly participated in the "moshing and other violent behavior" exhibited at the show. […] those who happened to fall were willing participants in the "violent behavior" that night and blaming someone else for their actions is irresponsible. […] This frivolous lawsuit is doing nothing more than dragging out a painful experience for many people and needs to be put to rest.

Death By Stereo, who will be releasing their fourth full length this spring titled Death For Life has finalized their tour dates for the next few months.
