Another volley in the legal battle between Victory and Hawthorne Heights was lobbed today as the label filed suit against the band's "new" label, EMI/Virgin.
The suit argues that:
Two top level executives among others presently unknown, induced the members of Hawthorne Heights to declare themselves free of the Victory Agreement at a time when the Band was not otherwise predisposed to do so.
and that the situation had left the band and label "so alienated that repairing the relationship may prove to be impossible."
The situation began in August when Hawthorne Heights filed suit against Victory, which was followed by a countersuit against the band in September. Despite all this, the band recently announced plans for a new CD+DVD package.
